4. Functions, duties and powers of the Board:

The Board shall have following functions, duties and powers:
(a) To operate and manage the Hospital.
(b) To formulate or cause to formulate the long term and short term plans for the management of the Hospital.
(c) To arrange the means and resources for the operation and management of the Hospital.
(d) To approve the budget of the Hospital.
(e) To determine the service fees of the Hospital.
(f) To protect and maintain the physical property of the Hospital.
(g) To submit annual report of the Hospital to the Government of Nepal.
(h) To carry out other necessary functions for the implementation of the aforesaid functions.

5. Meetings and decisions of the Board

5. Meetings and decisions of the Board:

(1) A meeting of the Board shall be held as specified by the chairperson of the Board.
(2) If one-third members of the Board make a submission in writing for the meeting the member secretary of the              Board shall call a meeting informing the chairperson thereof.
(3) In the case of the office of chairperson being vacant or the
chairperson being absent, the member secretary of the Board may, as required, call the meeting of the Board.
(4) The presence of fifty percent members of the total number of
members of the Board shall be deemed to constitute a quorum for a meeting of the Board.
(5) The meeting of the Board shall be presided over by the chairperson of the Board and by the person selected by            the members from amongst themselves in the absence of the chairperson.

(6) The majority opinion shall prevail at the meeting of the Board; and in the event of a tie, the person presiding                over the meeting shall exercise the casting vote.
(7) The decisions of the Board shall be authenticated by the member-secretary of the Board.
(8) The Board shall meet at least once in each four month.
(9) Other rules of procedures relating to the meeting of the Board shall be as determined by the Board itself.

Method of disinfection While disinfecting, any of the following chemical or physical methods shall be
applied considering upon the nature of the material to be disinfected:
1. Lime- 20 percent solution into water
2. Sodium Carbonate – 2 to 8 per cent solution into water
3. Sodium Hydrochloride- 1-5 per cent solution into water It may be used having mixed with 5 per cent solution of lime, if necessary.
4. Phenolic acid- 3-5 per cent solution into water.
5. Solution of mixture of phenolic acid and sulpheric acid- solution of the mixture or fifty millimeter into one liter of water.
6. Formalin- liquid of 40 per cent of formalin into water for the solution of 5 per cent.
7. Sodium hypochlorite- solution of 1-3 per cent into water.
8. Ultra violet light-continuous use for 2 hours in minimum.
9. Fire heat – use of blow lump.

N.B. Other available products of disinfection may also be used as per solution

6. Fund of the Board

6. Fund of the Board:

(1) There shall be a separate fund of the Board.
(2) The fund shall consist following amounts:
(a) Amounts received from the Government of Nepal for salary and allowances or grants for the operation of the               Hospital.
(b) Amounts received from services provided by the Hospital.
(c) Amounts received from other donor agency or donors.
(d) Amounts received from other sources.
(3) All expenditures of the Board shall be borne from the fund as referred to in Sub-section (1).
(4) The amount of the fund of the Board shall be deposited and operated in an account opened in the commercial               bank.
(5) The fund of the Board shall be operated with the joint signature of the Medical Superintendent and account chief.
(6) Any amount received from the Government of Nepal, any foreign government or international organization shall        be spent for the same programme or activity for which the amount has been received.

7. Audit

7. Audit:

(1) The accounts of the incomes and expenditures of the Board shall be maintained in accordance with the method            followed by the Government of Nepal.
(2) The audit of the Board shall be performed in accordance with the prevailing laws.
(3) The Government of Nepal may, if it so desires, inspect or cause to inspect the accounts of the Board, at any time.

2. Definition:

Unless the subject or the context otherwise requires, in this Order,
(a) “Chairperson” means the Chairperson of the Board.
(b) “Hospital” means the Chautara Hospital Development Board.
(c) “Prescribed” or “as Prescribed” means prescribed or as prescribed by the Rules framed under this Formation               Order.
(d) “Ministry” means Health and Population Ministry.
(e) “Member” means the member of the Board, and this term also includes the Chairperson and Member –Secretary        of the Board.
(f) “Board” means the Chautara Hospital Development Board formed pursuant to Section 3.

3. Formation of the Board:

(1) A Board to be named as the Chautara Hospital Development Board, is hereby, formed for carrying out the                     function of management and operation of the Hospital.
(2) The Board referred to in sub-section (1) shall consist of the following members:
(a) A person nominated by the Ministry from amongst the highly regarded persons -Chairperson
(b) Mayor, Concerned Municipality, where the Hospital is located -Member
(c) Officer Level Representative, District Development Committee, Sindhupalchok -Member
(d) Officer Level Representative, District Administration Office, Sindhupalchok -Member
(e) Chairperson, District Chamber of Commerce and Industry, Sindhupalchok -Member
(f) President, District Red cross Society, Sindhupalchok -Member
(g) One person nominated by the Board from amongst the women of concerned Ward of Municipality, where the              Hospital is located. -Member
(h) One person nominated by the Board from amongst the women who is involved in the health service. -Member
(i) Medical Superintendent of the Hospital -Member Secretary
(3) The tenure of the Chairperson and the nominated Members shall be two years.
(4) Notwithstanding anything contained in Sub-section 3, if the Chairperson or nominated Members fail to discharge
his/her duties or acts against the interest of the Board, the Ministry may dismiss him /her at any time. Provided          that, such members shall not be deprived of the opportunity to defend themselves prior to their dismissal

4. Functions, duties and powers of the Board:

(1) The Board shall have following Functions, Duties and Powers:
(a) to formulate and execute or cause to execute necessary policies for management and operation of the                               Hospital;
(b) to arrange necessary resources and means for the Hospital;
(c) to prepare and execute the annual program and budget;                                                                                                          (d) to determine the fees of the services of the Hospital;
(e) to take care and maintain the physical assets of the Hospital;
(f) to prepare standards for those sick people who are economically backward and disadvantaged;                                    (g) to arrange free medical services for those sick people who are economically backward and disadvantaged;
(h) to carry out other necessary functions as prescribed.

4. Ancient Monuments Preservation (First Amendment) Rules, 2058 (2002) 2058.12.5 (18 March 2002)

In exercise of the power conferred by Section 21 of the Ancient Monuments Preservation Act, 2013 (1956), Government of Nepal has framed the following Rules.

Chapter-1 Preliminary

1.1 Short Title and Commencement:
1.1.1 These Rules may be called “Ancient Monuments Preservation Rules, 2046 (1989)”.
1 Fourth Amendment was approved by the Cabinet on 2058/12/5 but the notice thereof is not published in Nepal Gazette.
1.1.2 These Rules shall come into force immediately.
1.2 Definitions :

1.2.1 Unless the subject or context otherwise requires, in these Rules-
1.2.1.1 “Act” means the Ancient Monuments Preservation Act, 2013 (1956).
1.2.1.2 “Department” means Government of Nepal, Department of Archaeology.
1.2.1.3 “Technical Committee” means the Technical, Committee as constituted by Rule 2.1.
1.2.1.4 “Co-operation Committee” means the Ancient Monuments Co-operation Committee as constituted by
Rule 3.1.
21.2.1.5 “Classification Committee” means the Ancient Monuments Survey and Classification Committee
constituted under Rule 2.3.
31.2.1.6 “Fund” means the Ancient Monuments Conservation Fund established under Rule 4.10.

5. Meetings and decisions of the Board

5. Meetings and decisions of the Board:

(1) Meetings of the Board shall be held as required by the Board.
(2) The Meeting of the Board shall be held on the date, time and venue as specified by the Chairperson,
(3) The Member Secretary of the Board shall provide notice to all members, including discussion agendas of the                 meeting at least 24 hours prior to the commencement of such meeting.
(4) The presence of fifty percent members of the total number of members of the Board shall be deemed to constitute
a quorum for a meeting of the Board.
(5) The meeting of the Board shall be presided over by the chairperson of the Board and by the person selected by the
members from amongst themselves in the absence of the chairperson.
(6) The majority opinion shall prevail at the meeting of the Board; and in the event of a tie, the person presiding                 over the meeting shall exercise the casting vote.
(7) The decisions of the Board shall be authenticated by the member-secretary of the Board.
(8) If necessary, the Board may invite any officer of the Government of Nepal or expert as an observer at the meeting         of the Board.
(9) Other Rules of procedures relating to the meeting of the Board shall be as determined by the Board itself.

2.1 Formation of the Technical Committee

2.1 Formation of the Technical Committee:

2.1.1 The following Technical Committee has been formed 4  to advice the Department on the design and standard of the house to constructed in the land under private ownership within the Protected Monument Zone:

2.1.1.1 Technical Officer, designated by the Department – Chairperson

2.1.1.2 Representative, Department of Building – Member

2.1.1.3 Representative, Department of Housing andTown Development – Member

2.1.1.4 Representative, Kathmandu Valley Town Development Programme Execution Committee – Member

2.1.1.5 An Architect, designated by the Department – Member

2.1.1.6 An Officer, designated by the Department – Member Secretary

2.1.2 The Technical Committee may invite to any national or international expert or advisor or any officer of Government of Nepal as an observer at its meeting.

2.1.3 The meeting of the Technical Committee shall be held as required.

2.1.4 The Technical Committee may determine other procedures relating to its meeting by itself.

2.2 Functions, Duties and Powers of the Technical Committee

2.2 Functions, Duties and Powers of the Technical Committee:

2.2.1 Upon deciding the design and standards of houses owned and occupied buildings or other constructions constructed in private land, within the Protected Monument Zone, it shall be the duty of the Technical Committee to give advise to the Department of Archaeology.

2.2.2 If the Technical Committee deems necessary, it may form the Sub-committees to carry out any specific function, from the functions stipulated in Sub-rule 2.2.1, and in such sub committee there shall be Members as designated by the Technical Committee.

2.2.3 The Sub-committee, to be formed pursuant to Sub-rule 2.2.2, shall carry out its functions applying the powers as prescribed by the Technical Committee

2.3 Ancient Monuments Survey and Classification Committee

2.3 Ancient Monuments Survey and Classification Committee:

2.3.1 In order to survey and classify the ancient monuments, the following Classification Committee has been formed:

2.3.1.1 Director General, Department – Co-ordinator

2.3.1.2 Head of Department, Centeral Teaching Department of Nepali,
History and Culture, Tribhuvan University – Member

2.3.1.3 Head of Department, Department of Architecture Institute of Engineering, Tribhuvan University – Member

2.3.1.4 Administrator, Guthi Sansthan – Member

2.3.1.5 Two persons designated by  Government of Nepal from amongest the experts related
with the field of Survey and Classification of ancient monument – Member

2.3.1.6 Representative, Monastry Management and Development Board – Member

2.3.1.7 An officer, designated by the Depatment – Member secretary

2.3.2 The Classification Committee may invite the chairperson of concerned Village Development Committee or the Chief of the Municipality or the representative of the concerned Village Development Committee or Municipality, the national or foreign expert concerned with the field of survey and classification of the ancient monuments or any officer of Government of Nepal as an observer in the meeting of the Classification Committee.

2.3.3 The meeting of the Classification Committee shall be held as required.

2.3.4 The Classification Committee may determine other procedures relating to its meeting by itself.

2.4 Functions, Duties and Powers of the Classification Committee

2.4 Functions, Duties and Powers of the Classification Committee:

2.4.1. Functions, duties and powers of the Classification Committee shall be as follows:

2.4.1.1 To prepare the survey report upon surveying the ancient monuments from time to time, in order to advice the
Department in relation to the Classification of the ancient monuments from the ownership and importance
perspectives.

2.4.1.2 Having prepared the criteria of the classification of ancient monuments from the ownership and importance
perspective on the basis of survey report prepared in accordance with Sub-rule 2.4.1.1 to advise the
Department to classify the ancient monuments on the basis of said criteria.

2.4.1.3 To form Sub-committees as required to prepare the report upon conducting survey of the ancient monuments as referred to in Sub-rule 2.4.1.1.

2.4.1.4 To carry out such other necessary functions as prescribed by Government of Nepal in relation to the survey and classification of the ancient monuments.

2.4.2 The composition, tenure of office, functions, duties and powers and other matters of the Sub-committees to be formed pursuant to Sub-rule 2.4.1.3 shall be as specified by the Classification Committee
